Petitioner-appellant Richard Blaisdell appeals from the May 10, 2002 order of the circuit court of the first circuit, the Honorable Victoria S. Marks presiding, denying Blaisdells Hawaii Rules of Penal Procedure (HRPP) Rule 40 petition for post conviction relief. On appeal, Blaisdell argues that his defense counsel rendered ineffective assistance of counsel by failing to: (1) investigate and call witnesses that could have bolstered his credibility; (2) object to the prosecutions deliberate creation of a highly prejudicial atmosphere; (3) effectively cross-examine the witnesses; (4) object to the prosecutions exclusion of uncharged facts presented by various complainants; (5) object to portions of the prosecutions closing arguments that were inflammatory and highly prejudicial; and (6) require the court to comport with the requirements of the extended term of imprisonment statute.
