This action involves a claim for personal injuries suffered by the plaintiff, a nine-year-old girl, when she was struck by an automobile owned and driven by the defendant, John A. Blakeman. The accident occurred just east of Tensleep, Wyoming, on U.S. Highway 16. At the time of the accident, plaintiff was riding a bicycle along the highway toward the east. The defendant, traveling in the same direction, undertook to pass her when something happened which caused her and her bicycle to be struck by defendants automobile. The defendant claims that just as he was about to pass, the plaintiff for some unknown reason made an abrupt left-hand turn in front of him. The issues were tried, without a jury, to District Judge D.J. Harkins. From a judgment awarding damages in the sum of $11,588 to the plaintiff, the defendant has appealed.
